Dr. Toby Allgood is reported to be suing Internet website Topics.Net, also known as
Topics, LLC, for defamation, libel and intentional infliction of emotion distress.  Two
other Defendants named "John Doe" and "Jane Doe " who use the user names of
"RainyDay1" and "NightMare2"  are also listed in the civil suit, "the names being
fictitious to represent writers on an Internet chat forum," the complaint says. Other
defendants will be added by an amended complaint as needed as discovery leads to
the "real" names. As of this article, we are not sure of anything and are just doing what
so many others do, spread some gossip as the gospel. After all, both words almost
sound and look the same.

The 13-page suit filed in the Civil Division of Circuit Court seeks actual, consequential
and punitive damages, exceeding $150,000, exclusive of interest, costs and attorney's
fees for each of the three counts. A jury trial has been demanded.

Mr. Allgood's attorney, Ramon Deeper told the Dayton Daily News that a court date
had not yet been set for the suit, but the case was "progressing." He declined to
comment further on the complaint except to say it was "self explanatory." He also
went on to say that the alleged evil, hatred works of John and Jane Doe may just be
the sadistical work of one bitter, impoverished woman in a small trailer with a dial up
connection. According to that famous gossip around town, several people say that these
two "anonymous" posters are actually the sinister work of one person, Karen Mundy
who is said to use the user name K_Dum1. l. Although that isn't the case as of yet, "I'm
sure with these hard economic times it may be hard to retain counsel, but she will have
30 days to answer the complaint or default", Ramon Deeper said.

The complaint alleges that on or about October 7, 2008, Toby Allgood discovered an
Internet chat forum maintained by Topics.Net, which contained statements pertaining
to him.  The complaint says the Defendants made false and defamatory statements and
made postings threatening the Plaintiff's wife's life, which caused the Plaintiff to fear
for his life as well.

"Due to Defendant's threats, Plaintiff was forced to purchase security cameras and
motion detectors.  Due to Defendant's outrageous conduct in the form of these
statements, Plaintiff has suffered severe emotional distress, monetary damages, and
has been subjected to hatred, distrust, ridicule, contempt, and disgrace," the

The complaint says that it is believed that the Defendants "John Doe " and "Jane Doe"
are personally acquainted with employees of the Dayberry Police Department.  It says
that Topics.Net administers a chat forum that includes local issues concerning
occurrences in Dayberry.  "The forum allows users to post comments anonymously on
the website using Internet pseudonyms. These postings are disseminated over the
Internet to any third party that enters the site. These postings are not privileged, and
access to the site is not restricted in any way."

"The Defendant(s) published these false and defamatory statements in non-privileged
communications over the Internet, thereby committing the tort of Defamation under
current Law," the complaint alleges. "The Defendants false and defamatory
statements caused special harm to Plaintiff and are actionable," the complaint
continues.

A subpoena requiring discovery has since been served upon Topics.Net starting the
process of tracing the IP adresses to the ISP and ultimately to the door step of John
and Jane Doe.
