




I agree that police should not run their radar at night in
attempt to catch a speeder. Perhaps under ideal
circumstances (only one car on the entire road) maybe it's
possible. In any event, one main factor everyone seems to be
overlooking is the use of the radar to NOT write a ticket, but
to give the probable cause to make a traffic stop.
Police need a reason to pull you over and tactics like shooting
radar at night is an effective tactic. As for Graysville, it's
police and charter, the simple plain rational answer is to dump
it's charter. Sure it may have been a thriving town at one
time but obviously, not anymore.
When the only real services a town can offer is police or
what they sell to us as so-called "protection" then buy a big
dog, put on a big door lock and buy a big gun. If anything
happens, call the sheriff. At the end of the day the sheriff
MUST enforce the law everywhere crime may be in his
county, including a city, period. The only exceptions are that
the sheriff may not enforce a city ordinance because a city
ordinance isn't a state law. Remember, city police were never
authorized by constitution, they were created. They are
basically not much more than a school, hospital or university
police officer. City Police are essentially the "corporporate"
security guards with quasi governmental functions granted
only to it by the state legislature. Police not only enforce
ordinanaces of the city, they also are empowered to enforce
state law. This action allows for tremendous revenues to the
city coffers due to police activity. Also, thew kicker is, police
owe YOU no duty whatsoever. I'm not going to stop and look
up the exact case law for such, but I will post it somewhere
in here soon.
Times are too hard to pay salaries to people just for the sake
of them having a public taxpayer job. We all want to help out
our family and friends but I for one am sick of paying for
things that benefit a damn clan, sorry folks.
One other thing we all seem to overlook, no matter what
anyone says, a constable costs the taxpayers absolutely
nothing. And to the rambling "brainchild" who says otherwise,
I challenge you to find any case where a constable caused any
liability upon any taxpayer or entity. Go find it and let me
know.
I think you will find that case law somewhere between the
easter Bunny and Santa Claus as it does not exist...
